Terms of Conditions of Nurture Pay

Welcome to Nurture (nurturecrm.in). Please read these Terms and Conditions (“Terms”) carefully before accessing or using our platform. By using our site, services, or any part of our aggregator system, you agree to be bound by these Terms.

1. Introduction

Nurture is an independent digital aggregator platform that facilitates access to loan and EMI-based financing solutions for educational institutions (“Institutes”) through third-party financial institutions, Non-Banking Financial Companies (NBFCs), and banks (“Lending Partners”). Nurture itself does not provide loans or financial services directly, but serves as a technology intermediary between the Institutes and Lending Partners.

2. Eligibility

Our services are strictly available to legally registered educational institutions operating within India. Institutes must meet the following eligibility criteria to be considered for financing options through the Nurture platform:

• Possession of a valid, legally recognized business registration in India.
• Adequate creditworthiness as determined by our Lending Partners.
• Valid documentation for KYC, bank verification, credit history, and compliance requirements.
• Consent to share financial, operational, and legal data with Nurture and our Lending Partners for assessment.

Nurture reserves the right to deny access to financing services if an institute fails to meet the eligibility criteria determined by us or our Lending Partners.

3. Nature of Relationship

Nurture:

• Is not a lender or financial institution, and does not extend loans or credit directly.
• Does not guarantee loan approval, credit terms, or processing times.
• Acts solely as a facilitation platform enabling Institutes to connect with potential Lending Partners.

All financing decisions — including eligibility screening, interest rates, loan tenure, EMI terms, and disbursal — are made exclusively by the Lending Partners and are subject to their internal underwriting policies.

4. Credit Assessment & Data Use

By registering or using our platform, you authorize Nurture to:

• Collect and share your institute’s financial and operational data with Lending Partners for loan assessment.
• Conduct credit checks (via authorized bureaus) as necessary for eligibility evaluation.
• Retain information provided for internal analysis, service improvement, and compliance with regulatory standards.

We are committed to handling your data responsibly in accordance with lenders Privacy Policy. However, Nurture shall not be liable for any misuse or unauthorized access once the data is shared with external Lending Partners.

5. Responsibilities of the Institute

The Institute agrees to:

• Provide accurate, complete, and updated documentation, financial records, and business information.
• Maintain confidentiality of login credentials and platform access.
• Cooperate with Lending Partners in fulfilling underwriting and disbursal requirements post-application.
• Comply with the loan agreement, repayment schedule, and terms as defined by the Lending Partner.

6. Limitations of Liability

Nurture will not be liable for:

• Decisions taken by any Lending Partner based on risk assessment or internal criteria.
• Any direct or indirect loss, including loss of business, incurred due to denial or delay of loan requests.
• Disputes arising between the Institute and Lending Partner regarding loan activation, loan terms, repayment, interest, or defaults.
• Any network, server, or third-party service errors affecting financing access via the platform.

7. Service Availability & Modifications

We do not guarantee uninterrupted access to the platform. Nurture reserves the right to modify, suspend, or discontinue any aspect of the service or these Terms without prior notice.

8. Governing Law

These Terms and any disputes arising out of or related to your use of the Nurture platform shall be governed in accordance with the laws of India. Any legal proceedings will be subject to the exclusive jurisdiction of the courts located in Bangalore.
